A Supreme Court lawyer on Monday filed a writ petition with the High Court challenging the Election Commission's decisions to hold national election and referendum on February 12.
Advocate Md Eunus Ali Akond, who submitted the petition as a public interest litigation to the HC, said the election and referendum cannot be held under the current interim government in accordance with the constitution and law.
He sought stay on the schedules issued by the EC on December 11 last year for holding the parliamentary election and referendum on February 12.
In the petition, he prayed to the HC to pass necessary directives to hold the national election under a caretaker government.
Citing the petition, Eunus Ali said that there is no provision of interim government in the constitution and the Representation of People Order (RPO) and therefore, the election and referendum cannot be held under the interim government.
He added the hearing of the writ petition might be held on Tuesday.
