SC verdicts: Registration of Trinamool BNP valid

The Appellate Division of the Supreme Court has upheld a High Court decision to register Trinamool BNP led by former BNP leader Barrister Nazmul Huda as a political party, valid.

A three-member bench of the apex court, headed by Chief Justice Hassan Foez Siddique, passed the order on Sunday (December 18), rejecting a leave to appeal filed by the Election Commission (EC) challenging the High Court’s verdict.

Lawyer Advocate Yasin Khan represented the EC at the apex court, while lawyers Advocate Shah Manjurul Haque along with Advocate M Harunur Rashid Khan argued on behalf of Barrister Nazmul Huda.

M Harunur Rashid Khan told media that the Appellate Division upheld the High Court’s decision to register Nazmul Huda-led Trinamool BNP as a political party. Following order of the apex court, 

there is no legal bar for the Trinamool BNP to be registered as a political party, he added. 

Advocate Yasin Khan said that the HC order to register Trinamool BNP, led by former BNP leader and ex-minister Barrister Nazmul Huda, will remain in place from today (Sunday).

Earlier on November 20 in 2015, Barrister Nazmul Huda, a former vice chairman of the BNP and also a former minister of the former BNP government, launched the Trinamool BNP (Grass-roots BNP). 

At the time, he said that Khaleda Zia-led BNP had failed to perform as a political party. Khaleda Zia’s party policies are completely contrary to that of BNP founder late president Ziaur Rahman. The party is being run by leadership of family inheritance from London, he had alleged.

The Election Commission rejected Trinamool BNP’s application for registration as a political party on June 14 in 2018. The EC on that day sent a notice to Barrister Nazmul Huda where it showed three reasons for not registering his party.

Later, Barrister Nazmul Huda filed a writ petition in the High Court challenging the EC’s denial. 

The HC bench of Justice Tariq ul Hakim and Justice Md Shohrowardi on November 4 in 2018 instructed the Election Commission to register Trinamool BNP of Barrister Nazmul Huda as a political party immediately.

The EC filed a leave to appeal in 2019 challenging the verdict, which was dismissed on Sunday.
