About 2,500 of the candidates filed writ petitions with the High Court (HC) to get appointment to the non-government schools, colleges and madrasahs across the country. Responding to their petitions, the higher court had ordered the NTRCA to recommend the 2,500 writ petitioners as teachers to the non-government educational institutions.
The Appellate Division of the Supreme Court (SC) has cancelled the order. The bench of the Appellate Division (AD) headed by Chief Justice Syed Mahmud Hossain on Monday (June 28) cancelled the order and rejected a contempt rule issued against the NTRCA authorities.
Earlier on June 13, the NTRCA filed an appeal challenging the order of the High Court. On June 22, a chamber court sent the appeal to the full bench of the Appellate Division for hearing.
Earlier on May 6, the higher court stayed the process for appointing 54,304 teachers to non-government schools, colleges and madrasahs and asked the NTRCA to recommend in seven days to the authorities concerned of the educational institutions to appoint the qualified candidates, who filed contempt of court petitions against the NTRCA.
The order was issued during the hearing on 20 contempt of court petitions filed by 2,500 qualified candidates.
On May 31, the HC bench in its fresh order lifted its earlier order that stayed the process for recruiting 54,304 teachers. The virtual HC bench of Justice Mamnoon Rahman and Justice Khandaker Diliruzzaman in the fresh order also directed the NTRCA to recommend to the authorities concerned for recruiting the 2,500 applicants in four weeks. The court also fixed June 30 for holding further hearing on the contempt of court petitions.
The HC withdrew its May 6 stay order after Attorney General AM Amin Uddin had informed the court that the NTRCA agreed to recommend for the appointment of the petitioners.
The Non-government Teachers’ Registration and Certification Authority (NTRCA) has not appointed thousands of qualified candidates, who received certificates from the NTRCA through 1st-12th teachers’ registration exams, due to the existing policy. Many of the candidates have already crossed 35 years of age and most of them have not been appointed to other institutions.
However, the NTRCA has made a fresh move for the recruitment of non-government teachers in thousands of vacant posts. The NTRCA on March 30 issued a public notice to recruit 54,304 teachers in MPO-listed educational institutions.
Contempt of court petitions were filed against former NTRCA chairman Ashfaq Hossain for not appointing the petitioners as directed by the High Court. He had been asked to implement a 2017 HC directive in 15 days.
The court earlier in 2019 issued a contempt ruling against the-then NTRCA chairman for not implementing the HC order even after two years had passed.
