The High Court (HC) has said that no teacher of school, college or madrasa could be suspended for more than six months.

In a verdict, the higher court said that if a teacher is suspended for more than this period, the order would be considered as null and void.

The HC bench of Justice M Enayetur Rahim and Justice Md Mostafizur Rahman delivered the verdict on Thursday (September 9) on the final hearing of the rule issued on a writ petition.

Md Badshah Miah, a schoolteacher of Magura who has been suspended for 14 years, filed the writ with the High Court.

Advocate Md Humayun Kabir, a lawyer of the Bangladesh Supreme Court, moved in the court for the schoolteacher, while Deputy Attorney General Bipul Bagmar represented the state.

Advocate Humayun Kabir said that there was no stipulated period for suspension of non-government teachers. This verdict has fixed the period for the highest six months. Now, if someone is suspended following any allegation, the complaint has to be settled within six months. Otherwise, the suspension will not be effective after six months.

He, however, said that details would be known after the release of the full text of the written judgment of the High Court.

According to the lawyer, Md Badshah Miah, an assistant teacher of Baharbagh High School in Magura Sadar, was suspended in 2007 for allegedly taking extra fees. The issue was not settled for a long time. Against this backdrop, Badshah Mia had filed the writ petition with the High Court in 2017. Later, the court had issued a rule at that time. The rule was settled on September 9 this year.
