Speakers at a webinar on Saturday observed that local and international investment and construction arbitration is gaining popularity in Bangladesh.
Besides, being a maritime nation, international arbitration like charter party claim involving local parties is a regular affair. Statutory ADRs relating to Taxation matters are popular and also often found as an efficient way of settling disputes, speakers added.
Japan Bangladesh Chamber of Commerce & Industries (JBCCI) organized the webinar on "Resolving Dispute out of Court" jointly with Rahman's Chamber a reputed Law Firn in Bangladesh a valued member of JBCCI too.
The Webinar was held on Saturday through Zoom online Meeting platform.
Asif A Chowdhury, President of JBCCI delivered address of welcome while Mohammed Forrukh Rahman, Head of Chamber,Rahman's Chamber presented keynote paper in the program. Dr. AKM Moazzem Hussain, Executive Director of JBCCI also delivered a short speech emphasizing the importance of this matter to do buisness in Bangladesh.
In the Webinar Respective Discussants (details given int he attachment) explained about Alternative disputes resolution comprising arbitration, mediation & negotiation or mutual conciliation is gaining popularity in Bangladesh due to several awareness initiations from different corners.
They said business communities are now more or less aware of ADR nowadays. The dispute resolution clauses in the agreement covering all three mechanisms are generally found in most contracts, for example, construction, commercial, joint venture agreements etc. Besides that our civil procedure code makes it mandatory for the court to try ADR before proceeding for trial.
Due to long delays in resolving disputes in court, ADR is gaining popularity within Bangladesh. The attendees had the opportunity to enhance their knowledge and to become aware of the current issues involving alternative dispute resolution in Bangladesh.
