Legal notice served seeking compensation

A lawyer has sent a legal notice to the authorities concerned, asking them to pay taka one crore to family of the seven-year old child Jihad for his tragic death. The schoolboy was killed as a roadside wall collapsed on him in the capital on Tuesday last.

Barrister Md Abdul Halim sent the legal notice on behalf of the Bangladesh Legal Aid and Services Trust (BLAST) and the Children Charity Bangladesh Foundation. The lawyer confirmed the matter to the media on Thursday (November 11). 

The notice was served to nine persons, including secretary of Housing and Public Works Ministry, chief engineers of Public Works Department (PWD) and Dhaka South City Corporation (DSCC), and CEO of the DSCC.

The lawyer said that they asked the authorities concerned to pay the compensation money to the victim’s family members. They requested the PWD and the DSCC to pay the compensation to Jihad’s family. 

If they don’t pay the compensation money to the family and respond to the legal notice in seven days, they will file a writ petition with the High Court, said the lawyer. 

Jihad, a Grade-I student of a government school in Azimpur area, was living with his family in Shahidnagar area of Lalbagh in the capital.

The child with his father Nazir Hossain, a betel leaf seller in Shahidnagar area, was on his way to school holding his father’s hand on Tuesday (November 9), like every other day. The boundary wall of PWD staff quarters southern colony collapsed on Jihad, his father and another motorbike rider in Azimpur area in the capital around 8:30am on the day, leaving the child critically injured.

He was rushed to Dhaka Medical College Hospital where the on duty doctors pronounced him dead.

The incident was recorded in a closed-circuit camera of a nearby building.

Local and Jihad’s family members said that the boundary wall was old and fragile. Residents of the area said that the wall was left uncared for, and unrepaired for years.

Jihad’s mother demanded a trial of the people responsible for the incident. She said that the victim could have been any other kid. She said that Jihad was the younger of her two sons and the most loved one.

His father Nazir said that they were not in a position to afford a legal battle seeking justice.
