The High Court (HC) has said that making derogatory comments about any person through Facebook post is a ‘heinous offence’, as the victim can be seriously affected psychologically and socially for the derogatory comment.

The HC bench of Justice JBM Hassan made the observation during hearing a bail petition filed by a couple who were in detention in connection with a case filed under the Digital Security Act. They were arrested for posting a derogatory comment about a female teacher of a primary school in Barguna.

The court, however, granted bail to the couple-- Md Akhtaruzzaman, an official of Grameen Bank, and his wife Tamanna Begum. Their bail was granted untill reopening of the regular court after the ongoing suspension of regular court functions.

Md Sagir Hossain Leon, a lawyer of the Supreme Court, moved for accused, while Deputy Attorney General Tushar Kanti Roy represented the state.

The Deputy Attorney General said that the HC granted bail to the couple on humanitarian ground as they have two children -- a 14-year-old son and a four-year-old daughter.

Sagir Hossain Leon said there is no legal bar to his clients' release from jail following the HC order.

The lawyer said one Dolly Akhter, a teacher of Latabaria Government Primary School in Barguna Sadar Upazila, filed the case against the duo with Barguna Police Station on June 4.

In the case, Dolly Akhter alleged that had Tamanna made a derogatory comment about her character on May 13 through creating a fake Facebook ID and, therefore, her reputation has been damaged and she has been seriously affected socially and mentally. Police arrested Akhteruzzaman and his wife Tamanna in connection with the case on the same day.
