The High Court (HC) has refused to deliver any order on a writ petition filed seeking its directive on the government to recruit doctors from the candidates who qualified the 39th BCS (special).
The HC bench of Justice M Enayetur Rahim refused the writ petition on Monday (August 2).
Some 1,360 candidates filed the writ on July 29 for a direction to appoint new doctors from the 6,000 candidates who qualified 39th BCS (special).
Advocate Yusuf Hossain Humayun and Advocate Moshiur Rahman appeared for the writ petitioners, while Deputy Attorney Generals Samarendranath Biswas and Bipul Bagmar represented the state.
The HC bench said, “It is the government’s decision how many doctors will be appointed and from which BCS. We cannot interfere in the decision. The writ petition can be moved if there is any violation of the law.”
The petitioners of the writ said that the government recently issued a circular for recruiting 4,000 new doctors through holding 42nd BCS examination, although 6,000 candidates who qualified 39th BCS were not recruited, as there was no vacant post at that time.
Some candidates who passed the 39th special BCS said that the special BCS was taken only for doctors. Therefore, doctors should be appointed from the waiting list without holding any more special BCS.
The circular of the 39th special BCS was issued on April 10, 2018. The preliminary examination was held on August 3 of that year. The Public Service Commission (PSC) published the final results on April 30, 2019 and recommended the appointment of 4,792 doctors.
A total of 37,538 candidates took part in the 39th BCS exam where 13,570 doctors passed the test.
About 4, 500 doctors were appointed as assistant surgeons and 250 as assistant dental surgeons through the 39th special BCS examination. Another 8,107 did not get any recommendation for recruitment as there was vacant posts. Of them, 2,000 were later appointed as assistant surgeons. The government appointed the 2,000 new doctors in 2,000 to deal with the Covid-19 situation.
