HC orders framing transfer policy for non-govt teachers

Although the non-government teachers in the country receive their basic salary from the state treasury, they have no right to go under transfer order like the government teachers and officials and employees of other departments. The transfer system was not introduced in the country till now. 

Many teachers and employees in the non-government schools, colleges and madrasahs across country want to minimise the gap lying between the government and non-government teachers through the introduction of a transfer system.

Experts said that the government should introduce a policy over transfer of non-government teachers as the transfer is a common phenomenon of government, semi-government, autonomous and other jobs. The transfer process brings transparency, novelty and harmony in the job, removes monotony and reduces corruption. 

Against this backdrop, the High Court (HC) has issued a ruling over formulating a specific policy regarding transfer of teachers and employees of non-government educational institutions in the country.    

The HC bench of Justice M Enayetur Rahim and Justice Sardar Md Rashed Jahangir issued the ruling on Thursday (June 3) following a writ petition. 

The HC bench in its ruling also asked the authorities concerned as to why the inactivity for not formulating a policy over transfer of teachers from an educational institution to another institution against vacant post should not be declared illegal. 

Six people, including Secretary of Secondary and Higher Education Division of Education Ministry, Secretary of Technical and Madrasah Education Division and Chairman of the Non-Government Teachers Registration and Certification Authority (NTRCA), were made respondents to the ruling. They were asked to respond within four weeks. 

A total of 130 teachers filed the writ. Advocate Mohammad Siddik Ullah moved the writ petitioners in the court, while Deputy Attorney General Orbindo Kumar Roy represented the state. 

Advocate Mohammad Siddik Ullah said that as per Section 12 of the Manpower Structure and MPO Policy-2018, the government can formulate a policy to transfer teachers and employees of educational institutions under the MPO scheme. The government should come forward to introduce a policy for transfer of non-government teachers and employees.    

It was known that the government had wished to introduce such a transfer policy last year with the aim of curbing irregularities in the transfer of the non-government teachers, but could not do so. The Secondary and Higher Education Department of the Education Ministry had worked to formulate the policy. A special software needs to be developed if the transfer process is introduced.
