HC commutes two convicts’ death penalty

The High Court on Tuesday (October 4) commuted the death sentence of two convicts to life-term imprisonment in the van driver child Nishan murder in Mirpur of Kushtia. 

The HC bench of Justice Md Rezaul Haque and Justice KM Imrul Kayes commuted the death sentence of the two convicts after holding hearing on the death reference and appeal filed by the convicts in the murder case.

The death-row convicts, whose sentences were commuted, are-  Santu Sheikh, 21, resident of Swarupdah village of Mirpur upazila in Kushtia and Md. Mahabub Islam, 22, of the same area. 

Lawyer of the Supreme Court KM Sarwar Jahan argued for the convicts in the court, while Deputy Attorney General Sheikh Saifuzzaman Zaman represented the state. 

On March 20 in 2017 Additional District and Sessions Judge of the second court of Kushtia Tauhidul Islam delivered the judgment in the murder case, awarding the death sentence to the two people.

After the pronouncement of the verdict by the trial court, the death reference was sent to the High Court for approval of the death sentence. The convicts also filed appeal. 

According to the case statement, 14-year old Nishan left his home with a van around 7:00 am on July 25 in 2015. His relatives looked for him as he did not return home at night. The next morning, police recovered Nishan’s butchered body from Kalabagan of Swarupdah Bhanga Batta at Mirpur Upazila. 

On July 26, Nishan’s father Inamul Mandal filed a case with Mirpur police station. Santu Sheikh was arrested during the police investigation. Police recovered Nishan’s van, knife and rope used in the murder. The police arrested the other accused Mahabub Islam on Santu’s confessional statement.

Later, police submitted a charge sheet against Sontu and Mahabul in the court. After the trial, the court gave the death sentence on March 20 in 2017.
