HC allows Evaly to appoint a retuted firm for audit

The High Court has allowed the Evaly’s interim board, formed by the High Court, to assess the liabilities of the e-commerce company, to appoint any reputed audit firm instead of KPMG (Rahman Rahman Huq) to carry out an audit of the company.

The single HC bench of Justice Muhammad Khurshid Alam Sarkar delivered the order on Tuesday (January 25) following an application of the Evaly’s board.  

Md Mahbub Kabir Milon, court-appointed managing director of the company, filed the application. 

Barrister Morshed Ahmed Khan appeared for Evaly’s board in the court, while Barrister Syed Mahsib Hossain was in favor of the writ petition, which was filed in this regard. 

Barrister Syed Mahsib Hossain told the media that two petitions were presented in the court on Tuesday. One of the customers applied to be a party in the case for non-receipt of payment for Evaly’s product. The court has registered his application. The board of Evaly made another request. On October 18 in 2021, the court issued an order to a company named KPMG to audit Evaly’s properties.

The company wants Tk 86 lakh from Evaly to conduct the audit. They did not want to reduce this amount. For this reason, the board of Evaly appealed to the court to appoint another audit firm for the audit. Following the hearing of that application, the court had ordered that the board of Evaly can audit their property through any reputed audit firm in the country.

Earlier on October 18 in 2021, the court formed a five-member body to oversee the overall management and the company affairs of Evaly. The HC on that day also asked Evaly directors to appoint KPMG (Rahman Rahman Huq) at its earliest convenience to carry out an audit of the company.

The court appointed justice Shamsuddin Chowdhury Manik, a former judge of the Appellate Division of the Supreme Court, as the chairman of the company and Mahbub Kabir Milon, an additional secretary of the government, as the ex officio managing director.
