The High Court has acquitted a youth named Tuhin Kazi, who was sentenced to death for killing his father Abu Saeed Kazi in Kodalia village under Mollahat upazila in Bagerhat in 2014.
However, the higher court has directed that the case be re-tried as the lower court concerned did not follow the trial proceedings properly during the trial in the murder case.
The High Court bench of Justice ASM Abdul Mobin and Justice SM Moniruzzaman pronounced the verdict on Sunday (March 27) after hearing the death reference, criminal appeal and jail appeal in the case.
Lawyers Farhad Ahmed and Sheikh Wahiduzzaman Dipu argued for the appellant in the court, while Deputy Attorney General Sujit Chatterjee Bappi represented the state.
Lawyer Farhad Ahmed said that the High Court has dismissed the death reference and allowed the appeal of the accused against the conviction. As a result, the only accused Tuhin Kazi has been acquitted. The High Court, however, ordered the lower court for retrial of the case.
The HC bench said that there was a mistake in the trial of the case. There are no other witnesses in this case. Police and others brought the accused and the accused confessed his guilt before them.
His (accused) father died. His uncles caught him and told police that he (Tuhin Kazi) had killed his father. However, no one has seen who killed him. Tuhin Kazi was occasionally mentally upset.
From time to time, he was also chained. Against this backdrop, the lower court concerned did not send him to the Civil Surgeon for any kind of examination. If the brain is deformed then he will be released. If it is right, there will be a verdict. But that was not done.
A Bagerhat court on August 30 in 2016 convicted Tuhin Kazi in its verdict. Later, the death reference was sent to the High Court for approval. Besides, the accused filed a jail appeal and a criminal appeal.
According to the case statement, Abu Saeed Kazi, 55, of Kodalia village was killed by his own son Tuhin Kazi in his own residence on August 5 in 2014. The son was arrested by the police.
Abu Saeed’s daughter Sumi Akhter filed a murder case against her brother Tuhin Kazi with Mollahat police station. Following the investigation, a chargesheet was filed against Tuhin Kazi on February 8 in 2015.
