Family Courts Bill, 2023 passed in the Parliament on Monday aiming to replace an ordinance of the military regime withsome changes.
Law Minister AnisulHuq moved the bill in the House and it was passed byvoice votes with Deputy Speaker ShamsulHuq Tuku in the chair.
The proposed law will replace the Family Court Ordinance, 1985.
As per the proposed law, the government can consider not only the court ofdistrict judges but also the courts of other judges equivalent to thedistrict judges as appellate courts for such cases.
Appeals can also be made to other courts of district judge status against the judgment of a trial court under the proposed law.
Besides, the bill has proposed to increase the court fee of family courtcases from Taka 50 to Taka 200.
In the previous law, the appeal of the case in the judicial court was onlyavailable to the court of the district judge.
This increased the pressure on the district judge to hear the case.
This amendment has been brought in the law to reduce the burden of cases.
According to the proposed law, there are more judges at the district level,women and children or labor courts.
It is stated in the proposed bill that the court fee for the case in thiscourt is currently Taka 50. It is proposed to increase it to Taka 200.
It covers matters of marital discord, divorce, marriage and child support.
