Evaly’s bldg owner becomes a party in a writ petition

Sheikh Salahuddin, the owner of the Dhanmondi office building of controversial e-commerce company Evaly, has been a party in a writ petition as a defendant. 

Besides, the High Court has recorded an offensive post on Facebook about the writ petitioner Md Farhad Hossain.

The higher court, however, has asked Salahuddin, to extend his all-out cooperation to the court-appointed board of directors of the company and their appointed auditor to carry out its audit work. He has also been asked to appear before the court whenever the court summons him.

The HC’s single bench of Justice Muhammad Khurshid Alam Sarkar issued the order on Thursday (February 24) after hearing the building owner, who appeared in the court complying with its earlier order.

Lawyer Abdur Razzak appeared in the court on behalf of Sheikh Salahuddin, while lawyer Syed Mahsib Hossain appeared for Farhad Hossain.

Earlier on February 17, the High Court summoned Salauddin to appear in person in the court on February 24. On that day, the court had said that if the building owner doesn’t appear before the court, the law enforcers would arrest him and produce him in the court. 

According to the lawyers, Salahuddin appeared in the court following the summon. He has been a party to the case. The court has also recorded an application filed by Farhad Hossain, a consumer of the Evaly who filed the writ petition seeking High Court directives for winding up of the organization, stating that he was being threatened through different online media including Facebook.

The lawyers further said that the same High Court bench had issued a show-cause notice on February 7 and issued a rule as to why the bank accounts of 20 people, including Sheikh Salauddin, should not be confiscated and sought an explanation by February 22.

On February 17, the High Court also allowed the controversial e-commerce platform’s former chairman Shamima Narsin and its former managing director and chief executive officer Mohammad Rassel to transfer 50 percent of their shares to three family members for running the company. The members are--- Shamima Nasrin’s father Rafiqul Alam Talukder, her mother Farida Talukder Lily, and her sister’s husband Md Mamunur Rashid.

The DIG prisons concerned have been directed to extend necessary cooperation in completing the process for transferring the shares of Shamima and Rassel, as both of them are now behind the bar.

The same HC bench issued the order after hearing an application filed by Rafiqul, Farida, and Mamunur saying that they are interested to take over the responsibility of the company for its revival.

In the order, the HC had said that Rafiqul, Farida and Mamunur cannot transfer or sell any share to any other person after receiving the shares.

The court also said the court-appointed board of directors of Evaly will determine the role of Rafiqul, Farida, and Mamunur in operating the company.
