The High Court has asked people not to move any writ petition as public interest litigation without being an aggrieved person or out of hobby.
The HC bench of Justice M Enayetur Rahim and Justice Sardar Md Rashed Jahangir said this on Tuesday while warning Supreme Court lawyer Md Eunus Ali Akond for filing a writ petition as public interest litigation without being an aggrieved person.
“You don’t have the Locus Standi (jurisdiction to apply) to file the writ petition in the altercation incident of a physician, police and magistrate. Don’t move any writ petition out of hobby. If we reject your petitions, we will impose a heavy cost on you. The decision is yours whether you will move the petitions. Be prepared to pay fine,” the HC bench told Eunus Ali Akond.
The lawyer on Monday filed the writ petition with the High Court seeking its directive for conducting a judicial inquiry into the incident of the altercation.
He sought permission from the HC bench on Tuesday for placing the writ petition for hearing. He also sought permission for placing another writ petition he filed recently.
In the writ petitions, Eunus Ali Akond challenged the legality of ongoing lockdown and sought an order for a judicial inquiry into the altercation.
Advocate Yunus Ali Akand is known as a writ petitioner. On October 12 last year, the Appellate Division of Supreme Court barred him from practising law before both its Appellate and High Court Divisions for three months for committing contempt of court by posting three derogatory comments about the judiciary on his Facebook. He was also fined Tk 25,000 for the incident.
In his reaction over Tuesday’s HC observation, Eunus Ali Akond said he will move the writ petition before another HC bench seeking an order for a judicial inquiry into the incident of an altercation involving a female doctor, an executive magistrate and law enforcers.
He said that the petition was filed praying to the court so that it directs the government to take stern action against executive magistrate Sheikh Mamunur Rashid and law enforcers for misbehaving with Dr Sayeeda Showkat, an associate professor of the Radiology and Imaging Department of Bangabandhu Sheikh Mujib Medical University (BSMMU). In the petition, the lawyer also challenged the legality of operation of the mobile court by the executive magistrate to hold trial of the incident on the spot.
On April 18, Dr Syeeda Showkat got involved in a heated argument with a magistrate and a policeman in Elephant Road area in the capital. The incident took place when police intercepted the car carrying the BSMMU physician and asked to show her ID card and movement pass. An executive magistrate was also present at the time.
Just after the incident, the video footage of the three-way altercation went viral on the social media.
