Destiny MD to stay in jail as SC rejects review plea

The Appellate Division of the Supreme Court has rejected the review of the bail application by Managing Director (MD) of Destiny Group Rafiqul Amin in two money laundering cases involving Tk 4,200 crore filed by the Anti-Corruption Commission (ACC).

The six-judge Appellate Division bench headed by Chief Justice Hasan Foez Siddique dismissed the review petition filed for reconsideration on Thursday (January 13).

Advocate Sayeed Ahmed, lawyer of Rafiqul Amin, told the media that his client has already served the sentence given as punishment for this crime. 

Advocate Khurshid Alam Khan, the lawyer of the ACC, said that the Appellate Division had granted Rafiqul Amin’s bail on condition but he could not fulfill any of those. 

The apex court later rejected his bail application and dismissed the review petition on Thursday. As a result, the order for dismissing his bail application remains upheld. So, Rafiqul Amin cannot be released from jail following the SC order, he added. 

On July 31 in 2012, the ACC filed two money laundering cases with Kalabagan Police Station in the capital against some Destiny officials, including its MD Rafiqul Amin and Director Lt Gen (retd) 

Md Harun-or-Rashid. It brought allegation that the Destiny MD did not produce the statement of his wealth and siphoned off money.  

Later, on January 28 in 2020, a Dhaka court jailed Rafiqul Amin for three years in the case.

On August 20 in 2020, the High Court bench of Justice Md Nazrul Islam Talukder and Justice Ahmed Sohel rejected the bail petitions of Rafiqul Amin as he did not pay any money to the government in line with the Appellate Division’s order.

Then, Rafiqul Amin, who is now in jail, filed the two petitions with the Appellate Division, challenging the higher court’s rejection orders.

On November 13 in 2016 Destiny Group MD Rafiqul and Destiny Multipurpose Cooperative Society Ltd Chairman Mohammad Hossain were granted bail by the Appellate Division on condition that they must pay the government Tk 2,800 crore in six weeks by selling 35 lakh matured trees planted under the company's tree plantation project.
